ABU DHABI — The country’s highest judicial authority, Supreme Federal Court, has ruled that using SMS service seeking divorce cannot be validated.
The interesting observation came about in the Court’s judgment on a divorce case filed by Ali Abdulla, a Fujairah resident, who sought separation on grounds that his wife, Tahani Abdul, had deserted him for no valid reason. She had allegedly returned to her parent’s house.
He had sent SMS messages to his wife stating “If you don’t come to Fujairah, you are divorced,” which he followed up with another message stating “If you do not come back, consider yourself divorced.”
The Court, however, rejected his case, stating that she had returned to Fujairah after some time, and his case did not hold good since he had not fixed any deadline for her return.
