Firm told to reinstate worker

ABU DHABI — The Federal Supreme Court recently ordered reinstatement of a worker whose services had been arbitrarily terminated after one year of absence from work.

In its verdict, the court pointed out that the worker could not resume duty after the end of his annual leave for acceptable medical reasons.

The maintenance firm for which the petitioner worked had terminated his service for failing to report back to work after the end of his annual leave. He stayed home for one year. The company got his visa cancelled and hired another worker.

The worker went to the Abu Dhabi Court of First Instance, where he submitted several documents duly endorsed by the UAE embassy in his country that proved his illness. The court ruled in favour of the worker, and ordered the institution to reinstate him. The ruling was upheld in both the Court of Appeal and the Federal Supreme Court.
