DUBAI — Rejecting appeals by the Dubai National Insurance Company and Diamond Lease Company, the Dubai Court of Cassation has directed them to pay Dh350,000 as a compensation to a man who suffered disability following a car accident in October 2003.

Nakwa Hatem Abdul Hamid who suffered crippling injuries in the accident in 2003 had filed a case in the Court of First Instance against the companies seeking two million dirhams as compensation for injuries. The car was owned by the lease company and its driver Kaikal Beer Bakandy Sobash was killed in the accident.
The Court of First Instance ordered the two companies to pay Dh350, 000 to the plaintiff. The defendants as well as the plaintiff did not accept the order and moved an appeal before the Court of Appeal, which upheld the lower court's verdict. The insurance company then appealed to the Court of Cassation arguing that the plaintiff had received medical treatment in Rashid Hospital and had not spent any money on the treatment. However, the Court ordered the companies to pay Dh350, 000 as compensation relying on the hospital report, which stated that the plaintiff had suffered 50 per cent disability.
