Firm told to pay contractor Dh188,000

ABU DHABI – The Abu Dhabi Federal Court of Appeal has upheld a lower court's verdict asking a contracting company to pay a sub-contractor Dh188,000 — the amount being the value of a bounced cheque.

The cheque, issued by the company to the sub-contractor, bounced for insufficient funds.

Court records showed that the complainant had worked with the company as sub-contractor and claimed the amount against the works he had executed. Ain Al Miaah (Water Spring) Trade and Import Establishment filed a lawsuit against Al Mansooriyya Contracting and General Maintenance demanding it pay Dh188,000, as fees, expenses and lawyer charges.

The establishment also lodged a complaint with the Public Prosecution, and thereafter, filed a lawsuit in the court.

The Abu Dhabi Federal Court of First Instance had forced the company to pay the full amount being claimed.

It also slapped the company with a Dh3,000 fine for issuing a dud cheque.
