Guarantor’s heirs to get back Dh1.5m

ABU DHABI — The heirs of a national will now get back an inheritance of Dh1,500,000, which their father was forced to pay 10 years ago when his partner refused to repay a loan for which the former had stood as a guarantor.

The heirs of H. H had filed a lawsuit at the Sharjah Court of First Instance against K. M, pleading that the latter pay them Dh1,500,000 with interest and compensation for the damages the former had suffered for the last 10 years.

The defendant, on the other hand, pleaded with the court that the heirs should pay him Dh3,700,000, which he claimed was owed by their father to him when they were partners in the food supply company.

An audit expert was appointed and on the basis of his report, the Court of First Instance ordered that the heirs be paid an inheritance of Dh1,500,000.

The defendant appealed against the verdict at the Court of Appeal where his petition was rejected.

The defendant then moved the Apex Court, but his petition was dismissed.
