Man run over by car to get Dh1m in damages

ABU DHABI — Supreme judicial authorities have ordered more than a Dh1 million compensation in favour of a Sudanese man who was run over by a car in Al Ain and was seriously hurt.

The driver, Talal Quaider Barakat, has been ordered to pay a sum of Dh1,090,166 million to Salih Mohammed Suleiman for causing permanent disabilities when his speeding vehicle hit Suleiman as the latter was crossing the road.

According to the medical report, the victim sustained brain injuries and several fractures of the ribs besides bruises on different parts of his body.

The Al Ain Legal Traffic Criminal Court had sentenced the convict to one month in jail and ordered him to pay the victim an amount of Dh819,500 in addition to the Dh500 fine, in accordance with the Sharia Law, the penal federal code, and Federal Law No. 21 of 1995 and its executive bylaws on road and traffic.

Barakat was found violating road and traffic rules by driving recklessly without paying heed to the safety of people, resulting in the running over of the victim. The convict appealed against the court order, claiming that the victim had violated the traffic signal which was showing red and was not supposed to cross the road.

Investigations that followed, however, showed that the convict was violating the speed limit as he was driving at 80-90kmph, while the maximum speed limit was 60kmph, and that he hadn’t slowed down even when approaching the pedestrian-crossing. The Supreme Federal Court decided that Barakat was guilty and ordered him to pay Dh1million to Suleiman for causing permanent physical disabilities, Dh66,666 for brain injury, Dh20,000 for broken teeth, Dh3,000 for fractures of the ribs, and Dh500 for bruises all over his body.
