Verdict on compensation for negligence quashed

DUBAI - The Dubai Court of Appeal, yesterday quashed a verdict of Court of First Instance, which ordered a dentist to pay Dh10, 000 to a patient for the damage he incurred as a result of removing his tooth.

The appeal court found the dentist not guilty due to a lack of evidence.

According to the ruling of the court of appeal, the medical reports did not contain any evidence on the negligence of the dentist who works for a private clinic.

It appears that pulling out of the tooth was made when the tooth was severely infected, and the complainant had denied in his memo this incident.

Moreover, the dentist had advised his patient that he could be treated without removing the tooth.

This confirmed to the court that no mistake had been made by the dentist and therefore neither he nor the private clinic could be held responsible. So, the verdict issued by the Court of First Instance was cancelled.

The complainant filed a suit against a dentistry and the dentist asking for Dh274, 000 as compensation due to the negligence on their part. Such neglect, he claimed, had caused him to suffer damage as a result of pulling his infected tooth. The dentist appealed the verdict and won the case.
