Zelorrahman killed Ayob (also an Asian) using a 25cm knife. They were both working in the Musafah Industrial Area in Abu Dhabi. The accused tried to prove to the court that the victim did not die because of the wound, which he had caused by stabbing the victim during a fight between them. He claimed that he died because of his three friends, who witnessed the crime and didn’t help him. The victim was bleeding for hours since early morning, asking for water, but without any response from his friends which proves that the killer (according to him) does not deserve the verdict issued by the Al Ain Shariah Court and backed up by the Court of Appeal, which was 10 years jail sentence and Dh150,000 blood money.
The details of the case state that the killer headed for a room in the labour camp to buy some cigarettes around midnight, and the victim who was drunk chased him while threatening him with a knife, demanding that he give him some cash. They got into a fight and the accused was able to knock the victim down, took his knife and stabbed him in the stomach. Three of the victim’s friends appeared on the scene. The killer told them that the victim was trying to rob him and that he merely defended himself. But when they heard that, they all ran away and left their friend lying on the floor in the dark hallway, bleeding and asking for water, but no one cared about him, thinking that he was just drunk.
The Supreme Court upheld the verdict issued by the Court of Appeal about the presence of intentional assault, and despite the fact that the victim’s family gave up their right for punishment according to the Shariah, the court stated that the accused became in control of the situation when he snatched the knife from the victim, after which he was not supposed to stab the victim. The court held him responsible for his death, and upheld the previous verdict against him, while raising the blood money to Dh200,000 according to Article 9-2003.
