Yahya Mabrouk had filed a lawsuit against his partner and brother Qasim to pay him his share of the value of Al Mabrouk Restaurant and Grill in Abu Dhabi on the ground that the latter had after a few months, stopped giving him the Dh7,000 as his monthly share of the business in violation of their agreement.
When Qasim did not pay anything for a period of three years and they failed to reach a solution, the case went to the courts.
The complainant demanded the termination of the partnership contract and appointment of court liquidators to estimate the value of the restaurant and its equipment, and to force the defendant to pay half of the estimated amount, in addition to the estimated business profit for the said period of three years until the case was completely resolved. He also sought payment of his court expenses.
After the expert's report was submitted, a lower court decided to terminate the contract and ordered the defendant to pay Dh250,000.
But both brothers appealed against the verdict. The defendant claimed that he had spent his brother's share in decorating the restaurant, while the complainant demanded his full share of the business.
