A Russian woman, wanted for fraud in her country, will not be extradited after Dubai Courts rejected the request.
The woman was wanted for a fraud incident which took place between October 2007 and August 2009.
Prosecutors launched an investigation after she was apprehended in February. The matter was referred to the court after recommending to send the woman back to her country.
The woman attended the Dubai court hearing in March this year and appealed to reject the extrication request.
Mr Hassan Elhais, her lawyer, from Al Rowad Advocates and Legal Consultants submitted documents to prove that the request was invalid. He argued that his client had served her jail term in her country after which she moved to the UAE.
He explained that according to the penal code, article 399, his client's charge is considered a misdemeanor in the UAE and Article 20 of the UAE's Criminal Procedures Law, states that misdemeanor charges are dropped after five years, which makes the extradition request void because it was filed after this period.
He added that the two countries treaty in relation to extradition matters conditioned that a wanted person shall not be handed to the authorities of his country if the case he or she was wanted for had been dropped due to time lapsed.
