The Sharjah Civil Court of First Instance on Sunday received the report from its medical panel. The civil case was filed by petitioners Mushtaq Ahmed and Shahid Iqbal who claimed that they were assaulted by the men during a group fight of bootleggers in January 2009. Another Pakistani national, Misri Nazir Khan, was killed in the same fight for which the 17 men had earlier faced a death penalty.
In its last hearing on February 15, the civil court had asked the petitioners to undergo medical examination by a member of its medical panel and sought the reports to be submitted before the court the next day of hearing.
“The court-appointed doctor submitted the medical report to the judge today,” said advocate Bindu S Chettur of Mohamed Salman Advocates and Legal Consultants, appointed by the Indian government to defend its citizens. Ahmed said the court’s doctor had examined him, but not his brother, who has been in Pakistan since 2009. “My previous medical reports were already submitted to the court and the doctor has now certified that I have sustained 40 per cent disability. But, Shahid’s reports are yet to come from Pakistan,” he said.
Chettur said the court adjourned the case to May 7 for the next hearing. She said the judge would consider the medical report presented by its panel and the defence arguments before pronouncing its judgement in the compensation claim. The release of the 17 men, who currently face a travel ban due to the civil case, depends on the verdict.
