His Highness Shaikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai, has issued Cabinet Resolution No. 6 for 2014 on the Executive Regulations of Federal Law No. 7 for 2012 regarding the regulation of the ‘expert’ professionals who appear in courts.
Published in the latest release of the official gazette, the resolution forbids non-professionals from appearing in courts as ‘professional experts’ unless unanimously agreed upon by litigants in the case and approved by the courts for giving opinion.
The resolution requires that professionals appearing in courts as ‘experts’ pass a number of tests, training sessions and procedures defined by the Minister of Justice. A record of all professionals appearing in courts as ‘experts’ in their field shall be created at the Ministry of Justice complete with the list of professions, case type and financial value.
For the purposes of implementing the resolution, a committee for professional affairs is to be established at the Ministry of Justice with a mandate to accredit professionals as ‘experts’ to appear in courts. The committee will oversee the process of accepting applications from professionals, carrying out assessments and tests, and issuing a three-year renewable certification for experts.
The committee for professional affairs will also look into complaints raised against ‘experts’ appearing in courts and oversee investigations in such cases and follow up on procedures with a specialised disciplinary board.
