The law
Regarding the lands granted to entities owned by the government, the Decree states that if the Government or the Government's subsidiaries own over 50 percent of the entity's capital, then the land may be mortgaged unconditionally. The lands granted to real estate developers are considered freehold and may be mortgaged unconditionally and with discretion.
The Decree also permits mortgaging against the commercial or industrial property's income, and the mortgagee may manage the property and receive its income until the mortgage is satisfied. The Decree also states that the Civil Court is the entity responsible for settling any disputes arising from the mortgage, and the granted residential land may not be sold if the mortgagor defaults unless approval from the Board of the Mohammed bin Rashid Housing Establishment is obtained.
