Stating that the damaged line was shown nowhere in the site drawings provided by Etisalat.

The case was brought up before the court when the Public Prosecution accused Al Mulouk Contracting Company of damaging a cable out of negligence and lack of precautionary measures while carrying out excavation work.

The Public Prosecution demanded that the company be punished in accordance with Articles 424 and 43/1 of the Federal Penal Law.

The Court of First Instance ruled that the company be fined Dh500 for the cable damage. Pleading before the Court of Appeal, the company, however, said that as Etisalat's site drawings did not show the line in question, the charge of negligence and inadvertence stood refuted.

Taking that into consideration, the Court of Appeal ruled that the company be exonerated and the fine revoked.
