On November 24, the Delhi court quashed the notice of the Indian consulate in Dubai for the revocation of his passport, although the Delhi Police complaint against him still stands.
Describing the entire controversy as "politically influenced and deliberately manipulated" by the brother of his late wife Shalini Jain, who committed suicide at her Sharjah home on July 20, 2002, Shailender, a systems analyst in Dubai Police, alleged that he and his two children aged 8 and10 had been mentally tortured by the unnecessary allegations against them during the last one year."
Delhi Police had, in August 2002, registered a case against Shailender, who has been working in Dubai for the last 20 years. He was charged with dowry death under section 498A of the Indian Penal Code applicable to a husband or relative of a husband for wilful conduct that is likely to drive her to suicide. Shalini, who was married to Shailender for more than 11 years, had committed suicide at her Sharjah residence by pouring kerosene on herself. In her dying statement, however, she did not blame anybody.
According to Shailender, his brother-in-law Rajeev Jain who is an Officer On Special Duty (OSD) with the Ministery of Shipping, Government of India, was using his influence with the Ministry of External Affairs, to get the Indian consulate to revoke his passport, on grounds that he was not cooperating with the police in investigating the murder case against him in India.
He said that the consulate's notice was malafide and the sole motive was to ensure that he loses his job in Dubai.
The Sharjah Police had re-investigated the case last year and concluded it was a suicide.
The case was then was closed on the orders of the UAE Ministry of Justice and Prosecution in August 2003.
The cremation of Shalini was attended by her younger brother and sister in Dubai.
"My wife was emotionally blackmailed by her family members for money. I've documents to prove the enormous amounts of money that have been transfrred by my wife to her family members at their behest, " Shailender said.
