Egyptian Mohammed Moustafa handed to the court panel presided by Judge Rifaat Mahmoud Tulba the financial report he prepared after auditing the accounts in a case involving the 43-year-old former CEO of the property developer and eight other defendants.
The Public Prosecution also handed to the court a list specifying the powers bestowed on the American ex-CEO in Deyaar at the time of the alleged embezzlement. The court adjourned the hearing to March 3.
The ex-CEO is accused of fraud and embezzlement (about Dh240 million from Deyaar), breach of trust, forgery and use of fake documents and divulging Deyaar’s confidential information. He is being prosecuted in two cases at the Criminal Court of First Instance for alleged financial irregularities.
The other defendants include a Lebanese, a Palestinian, an Argentinean, a Pakistani and four Indians.
One of them is a runaway Indian former manager of operations of Deyaar. They are facing charges of forgery, fraud, breach of trust, divulging of confidential data and criminal complicity.
Deyaar is being represented in a civil suit in the court by Eissam Al Tamimi’s advocates and is claiming Dh240 million in damages.
Earlier, Moustafa told the court that out of a construction deal worth about $13 million, only $6 million was paid to a firm affiliated to Deyaar while the remaining was embezzled.
The project under the deal was carried out by a construction firm belonging to Deyaar in Turkey. It consisted of building a complex of villas. “While our books tell that $13 million was paid for completion of the project, the operation officials responsible for sale said that they received only $6 million,” Moustafa claimed. — mary@khaleejtimes.com
