An Egyptian waiter, 39, identified as Y.B., who allegedly accidentally pushed a drunk man causing him to fall, hit his head on the floor and die was charged with assault leading to death in the Court of First Instance on Thursday.
The incident happened on August 31, last year at a hotel in Naif.
An Egyptian security guard, 38, said in the investigation that he saw the victim walking out of the bar in a drunken manner during closing at around 3.30am.
"He was apparently under the influence of alcohol and he sat at the reception and ordered a taxi."
When the taxi arrived, the victim walked towards the hotel entrance. "I opened the door for him, but he did not walk out. He stood there and said words which I did not understand."
Y.B., who works at the Arabian night club in the hotel then came and tried to exit the place, passing between the guard and the victim. But the victim pushed him. The defendant tried to walk out again, but the victim pushed him again. "Y.B. then pushed the victim's shoulder with his hand and walked towards the parking lot behind the hotel."
The victim lost control and fell down on his face, passing out.
The victim was bleeding from two spots on his forehead and neck. Y.B. came in later and was surprised that the victim had fallen down because of his push. The latter was rushed by ambulance to the hospital.
A police officer took Y.B. to Naif police station shortly afterwards.
He admitted there that he was a small altercation with the victim when the latter tried to stop him from passing through the hotel's gate and that he pushed him on his right shoulder because of that.
According to the forensic report, the victim's death resulted from fractures in his neck and nose and injury to the spinal cord. He was then under the influence of alcohol and that limited his perception, balance and reaction.
Footage from the hotel surveillance cameras is being used by the public prosecution as evidence.
The court has adjourned the hearing to February 4.
